When a Muslim is asked to sign a contract that may not align with Islamic principles, they can consider the following:

  • Islamic interest
    The Muslim side should prioritize Islamic interest when agreeing on issues. 

  • Mutual cooperation
    All transactions should be based on the principle of “Ta’auanu ala birri wa’t-taqwa”, which means mutual cooperation for the cause of goodness or piety. 

  • Prohibited elements
    The Holy Quran prohibits interest (riba), uncertainty (gharar), and gambling (maysir) in any transaction. 

  • Elements of a valid contract
    A valid contract in Islam requires the following elements:

    • An offeror and an offeree 
    • An offer and acceptance 
    • A subject matter and consideration 
    • The parties must be at the age of puberty and have sound judgment
